Registration of Marriages already solemnised in India

Marriages solemnized in India can be registered under the Hindu Marriage Act, 1955 (if both parties are Hindus, Buddhists, Jains, or Sikhs) or the Special Marriage Act, 1954 (if parties belong to different religions or have already married under personal laws).

Eligibility
  • The marriage must have already been solemnized in India as per religious rites or customary practices.

  • Either the bride or the bridegroom must be a resident within the jurisdiction of the Marriage Registrar (Sub-Divisional Magistrate / Registrar of Marriages).

  • The parties must be:

    • At least 21 years old (groom) and 18 years old (bride).

    • Not in a prohibited degree of relationship (unless permitted by custom).

    • Not having a subsisting valid marriage.

Fee
  • Registration fee varies from ₹100 to ₹500, depending on the State/Union Territory and whether registered under the Hindu Marriage Act or the Special Marriage Act. In Delhi it is Rs.500/- 

  • Payment is generally made at the local Sub-Divisional Magistrate’s (SDM) office or via the State Government’s online portal.

How to Apply
  1. The bride and groom must apply in person at the office of the Marriage Registrar (SDM / Collectorate / Municipal Office) within whose jurisdiction either spouse resides.

  2. Both parties along with two adult witnesses are required to be present at the time of registration.

  3. An appointment can usually be booked online through the State Government’s portal or by visiting the Registrar’s office.

Documents Required
  • Application Form for Marriage Registration (available online or at Registrar’s office).

  • Marriage Invitation Card (if available).

  • Marriage Photograph(s) and a photograph of the marriage ceremony.

  • Proof of Marriage: Priest’s certificate or any documentary evidence of solemnization.

  • Identity & Address Proofs (Aadhar, Passport, Voter ID, Driving Licence, etc.) of bride, groom, and two witnesses.

  • Date of Birth Proof of both bride and groom (Birth Certificate, Passport, or School Leaving Certificate).

  • Passport size photographs of both bride and groom.

  • Affidavit stating date and place of marriage, marital status, nationality, and confirmation that both are not related within prohibited degrees.

Processing Time
  • Generally 7 to 15 working days from the date of application (varies by state).

  • Same-day registration is possible in some jurisdictions, depending on the workload of the Registrar.
